This privacy policy ("Privacy Policy”) describes the practices of Lovability LLC (“Lovability”, “we” or “us”) for how your personal and non-personal information is collected, used, and shared when you visit or make a purchase from our store at www.lovabilityinc.com and/or blog at www.babewiththepower.com (the “Sites”) or use any other products or services made available by us (collectively with the Sites, the “Services”).

Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. The use of information collected through our Services shall be limited to the purposes described under this Privacy Policy and our Terms of Use located at www.lovabilityinc.com. By accessing or using the Services, you agree to this Privacy Policy. If you are using the Services on behalf of an entity, you are agreeing to this Privacy Policy for that entity and are representing to us that you have the authority to do so (in which case “you” will refer to that entity). If you do not agree with our policies and practices, your choice is not to use the Services.

INFORMATION WE COLLECT
When you purchase something from our stores, as part of the buying and selling process, we collect the personal information you give us, such as your name, address, email address, mailing address, phone number and credit card information (the “Personal Information”), generally to fulfill any orders placed through the Sites (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). We may also use this Personal Information to communicate with you, screen orders for potential risk or fraud, and, when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services. 
 
When you browse our store and blog, we automatically receive your computer’s internet protocol (IP) address to provide us with information that helps us learn about your browser and operating system; this helps us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Sites (for example, by generating analytics about how our customers browse and interact with the Sites, and to assess the success of our marketing and advertising campaigns). We, and third-party services acting on our behalf, collect this "Non-Personal Information" using the following technologies:

  - “Log files”: they track actions occurring on the Sites, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

HOW WE USE YOUR INFORMATION
We may use your Personal Information and Non-Personal Information that we collect or that you provide to measure usage of the Services, to analyze the effectiveness of our Services, to conduct research, to improve and enhance functionality of the Services, to provide support for the Services and respond to requests and inquiries, to provide you with notices, such as updates or changes that we may make to the Services, to provide you with our newsletter and to market and advertise the Services, including through promotional e-mail messages, directly or in partnership with other parties, and by displaying our advertisements on other websites that you visit or use. We may disclose your Personal Information and Non-Personal information to service providers or other third parties, such as vendors, technical agents, subcontractors and consultants, to perform certain business-related functions that help make the Services and our offerings available and functional, including, but not limited to, design services, installation services, web site hosting, data analysis and metrics services, maintenance and technical services, customer service and support, email delivery services, infrastructure services and to help us in our marketing efforts, including managing and delivering contextual and tailored advertisements. We will not actively share Personal Information with third-party advertisers for their direct marketing purposes unless you give us your consent.
PUBLICLY POSTED
If you post information on public areas of the Sites or on any site through which our Services are offered and sold (i.e., comments or blog), that information is visible to and may be collected, stored and used by anyone. By posting information, you agree that you have obtained all necessary consents to make such information public and that doing so will not violate any laws. If you remove information that you have made public through or related to our Services, copies may remain viewable in cached and archived pages of our Services or if other users have copied or saved that information. We are not responsible for the actions of any third parties with whom you share Personal Information. Likewise, if you post information to various third-party services or platforms, such as social networking services such as Instagram, Twitter and Facebook via our Services, you acknowledge that your friends, followers and subscribers on these third party services or platforms will be able to view such activity. Any use of the information by such social networking websites will be governed by their privacy policies, and we do not control their use of the shared data.

INFORMATION YOU VOLUNTARILY PROVIDE
If you contact us by phone, email, text, social media, or by some other means, or if you sign up for our newsletter, we may keep a record of your contact information (including your name, company name, email, address and phone number) and the correspondence. When we send you emails, we may also track whether you open them to determine how to deliver more helpful emails and improve our Services.

Referral Service: if you wish to use our referral service (anticipated in fall 2019) to tell a friend about us, we will ask you for your friend’s name and e-mail address.  We will automatically send your friend a one-time email inviting him or her to visit the Site(s), and we will not retain your friend’s information.

CONSENT TO COLLECT, USE AND DISCLOSE YOUR INFORMATION
When you provide us with Personal Information to complete a transaction, verify your credit card, place an order, arrange for a delivery, or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only. 
If we ask for your Personal Information for a secondary reason, like marketing or promotional communications, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no. If, after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, clicking the “unsubscribe” link in any promotional emails, checking the relevant box located on the form on which we collect your data or emailing us at hello@lovabilityinc.com.
 
Regarding Cookies:
You have the option to accept or disable cookies at any time through your browser. You may refuse to accept browser cookies by activating the appropriate setting on your browser. If you choose to disable your cookies, your user experience may be limited.

Regarding Google Analytics:
You can opt out of tracking by Google Analytics by using Google’s Ads Settings or going to https://tools.google.com/dlpage/gaoptout/. You may also opt out of Google marketing products, but please note that this does not opt you out of being served generic ads.
 
THIRD-PARTY ADVERTISING
For more information about how targeted advertising works and your choices to prevent third parties from delivering tailored web advertisements, visit http://www.networkadvertising.org/choices

We do not control or operate these tools or the choices that advertisers and others provide through these tools. Please note that you may still receive advertisements from third parties within our Services even if you opt out of tailored advertising but they will not be based on your activity across unrelated web sites.

DO NOT TRACK
Third parties may keep track of your browsing activities across third party websites. California Business and Professions Code Section 22575(b) provides that California residents are entitled to know we respond to “Do Not Track” browser signals. Certain web browsers enable users to activate a “Do Not Track” signal but we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

YOUR RIGHTS (CALIFORNIA RESIDENTS)

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. Additionally, if you are a European resident, we are processing your information to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

DATA RETENTION
When you place an order through the Sites, we will maintain your order information for our records unless and until you ask us to delete this information. If you wish to access, update, correct or delete any Personal Information in our possession that you have previously provided, please contact us at hello@lovabilityinc.com
. We do not guarantee that any Personal Information can be removed completely.

SHOPIFY
Our store (including access via our blog) is hosted on Shopify Inc. which provides us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall. Payment: if you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the payment card industry data security standard (pci-dss). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. NOTICE TO CALIFORNIA RESIDENTS
California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a calendar year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please send an email to hello@lovabilityinc.com. If you are under 18 years of age, reside in California, and have a registered account with the Site(s), you have the right to request removal of unwanted data that you publicly post on the Site(s). To request removal of such data, please contact us using the contact information provided and include the email address associated with your account and a statement that you reside in California. We will make sure that the data is not publicly displayed on the Site(s), but please be aware that the data may not be completely or comprehensively removed from our systems. THIRD PARTY SERVICES; LINKS
In general, third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions; the policies and procedures described in this Privacy Policy do not apply to those third-party sites. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your Personal Information will be handled by these providers.

Note that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.
